1. Introduction

These Terms and Conditions (Terms) set out the basis on which you may access and use the Chip & Charcoal website located at https://chipandcharcoal.com (Site) and any dining, event, or social experiences you book with us through the Site or via our team (together, the Services).

By accessing or using the Site, placing a reservation, or engaging with our Services, you agree to be bound by these Terms and any additional terms referenced on specific pages (such as our Privacy Policy and Cookie Policy).

If you do not agree with these Terms, you should not use the Site or proceed with a reservation or event enquiry.

2. Eligibility & Access

By using our Site or Services, you confirm that:

  • you are at least 18 years of age; or
  • you otherwise have legal capacity to enter into binding agreements under the laws of Australia; and
  • you are accessing the Site and Services for lawful purposes only.

Children are welcome at Chip & Charcoal but must at all times be accompanied and supervised by a parent, guardian, or other responsible adult. Adults remain responsible for the conduct and safety of any minors in their care while on our premises or participating in our activities.

We may, at our discretion, refuse access to the Site or Services, cancel reservations, or request that guests leave the venue where behaviour is unsafe, unlawful, disruptive, or inconsistent with our house policies or applicable Australian law.

3. Reservations & Bookings

Our online reservation tools and enquiry forms are provided to make it easier to plan your visit to Chip & Charcoal, including dining, group bookings, and private functions.

All online reservations and booking enquiries are subject to review and confirmation by our team. Submitting a request through the Site or contacting us via the Contact page does not guarantee availability until you receive a confirmation from us.

For larger groups, private events, or special occasions, we may require a deposit or pre-authorisation to secure your booking. Any such requirements, including payment terms, minimum spend, and cancellation conditions, will be explained at the time of booking.

Cancellations and changes to reservations must comply with our stated policy, which may vary based on group size, date, time, and event type. Where applicable, failure to provide sufficient notice may result in forfeiture of deposits or the charging of a cancellation fee, as permitted under Australian law.

4. Dining Experience

We strive to keep information on our Site accurate, current, and helpful, including details about our menu, pricing, dietary options, and venue features. However, all items and pricing are subject to availability and may change without prior notice.

Images, descriptions, and sample menus on the Site are for illustrative purposes only and may not always represent the exact dishes, portion sizes, or presentation available on a particular day or service.

We make reasonable efforts to accommodate dietary requirements and food allergies when they are clearly communicated to our staff in advance and at the time of ordering. However, because our kitchen and bar handle a variety of ingredients, we cannot guarantee that any menu item is completely free from specific allergens.

We reserve the right to update our opening hours, seating arrangements, service offerings, and in-venue experiences at any time to maintain a safe, enjoyable, and compliant environment for guests and staff.

5. Poker Nights Disclaimer

Chip & Charcoal hosts offline poker nights exclusively as a social and recreational extension of our dining experience. These sessions are designed for entertainment, connection, and friendly fun among guests.

To avoid any doubt:

  • no real-money gambling, betting, or wagering is hosted, promoted, or facilitated by Chip & Charcoal on the Site or at the venue;
  • no cash prizes, real-money pots, or monetary rewards are associated with our poker nights; and
  • we do not provide or endorse online casino services, online poker, sports betting, gambling operators, or any form of real-money gaming or gambling offers.

Participation in our offline poker nights is entirely voluntary and intended purely for entertainment. Guests must follow our house rules and directions from staff at all times. We may modify or discontinue poker activities, adjust formats, or limit participation to ensure a safe, inclusive, and non-gambling environment.

6. Private Events

Chip & Charcoal offers private and semi-private bookings for occasions such as birthday parties, corporate dinners, family celebrations, team-building dinners, and other social events.

All private event requests are subject to availability, suitability of the occasion, and our operational capacity. We may ask you to enter into a separate event agreement or contract setting out specific terms, including event details, minimum spend, menu selections, payment schedules, cancellation rules, and any additional conditions that apply.

Use of the venue for private events must comply with these Terms, any event-specific agreement, our house policies, and all applicable Australian laws and regulations, including requirements related to responsible service of alcohol, noise, safety, and respect for our staff and other guests.

We may decline, postpone, or end an event if it presents safety concerns, breaches legal requirements, or is inconsistent with our values, policies, or the non-gambling nature of our poker-related activities.

7. Liability Limitations

To the maximum extent permitted by Australian law, Chip & Charcoal and its owners, staff, and representatives are not liable for any loss, damage, cost, or expense (whether direct, indirect, consequential, or otherwise) arising from or in connection with:

  • your use of, or inability to use, the Site or any of its features;
  • your reliance on information, images, or materials presented on the Site;
  • any interruptions, errors, viruses, or technical issues affecting the availability or performance of the Site; or
  • your attendance at, or participation in, any dining experience, event, or social activity at our venue, including offline poker nights.

Nothing in these Terms is intended to exclude, restrict, or modify any guarantee, right, or remedy that you may have under the Australian Consumer Law or other non-excludable laws. Where our liability cannot be excluded but can be limited, our liability is limited to, at our option, resupplying the relevant Services or paying the cost of having the Services resupplied.

You are responsible for your own conduct and that of any guests or minors under your supervision while at Chip & Charcoal. You agree to follow reasonable instructions from our staff and to take care to protect your personal belongings, health, and safety.

8. Changes to Terms

We may update or amend these Terms from time to time to reflect changes in our operations, Services, legal requirements, or the way we engage with guests and visitors to the Site.
